Common questions

Does my small business legally need a fire risk assessment?
Yes. The Regulatory Reform (Fire Safety) Order 2005 (RRO 2005) requires every employer and person responsible for non-domestic premises to carry out a 'suitable and sufficient' fire risk assessment. Since October 2023, the Building Safety Act 2022 requires ALL responsible persons to record their FRA in writing. The previous exemption for businesses with fewer than 5 employees no longer applies.
What is the penalty for not having a fire risk assessment?
Non-compliance with the RRO 2005 is a criminal offence. Fire services can issue enforcement notices, prohibition notices (forcing closure), and prosecute responsible persons. Penalties include unlimited fines and up to 2 years' imprisonment. In the event of a fire causing injury or death, absence of a FRA will be treated as gross negligence.
Can I complete a fire risk assessment myself?
Yes, for most small offices and low-risk premises. The RRO 2005 requires the assessment to be carried out by a 'competent person': someone with sufficient knowledge, training, and experience to identify fire hazards and evaluate the risk. For larger or more complex premises (5+ storeys, 50+ employees, or premises with cooking facilities), a professional fire risk assessor is strongly recommended.
What standard does FRASafe's commercial assessment follow?
FRASafe's office and small business assessment is structured in accordance with PAS 79-1:2020, the BSI code of practice for fire risk assessments in premises other than housing. This is the equivalent standard to BS 9792:2025 (residential) and is recognised by fire authorities and insurers as the benchmark for non-domestic FRAs.
How often does a fire risk assessment need to be reviewed?
Under RRO 2005 Article 9, the responsible person must review the assessment at 'regular intervals' and whenever there has been a significant change, such as a change of occupancy, a structural alteration, a change of processes, or following any fire or near miss. In practice, annual review is the standard.
